In order to conduct Business in the UAE, a foreign investor is required to establish a formal legal presence (Directly or through an agent) within the UAE through any of the following means
  • Incorporating a local Company (Main Land Company)
  • Registering a Branch or Representative office of a Foreign company
  • Establishing a Free zone entity
  • Entering into a Commercial agency relationship
Most foreign businesses choose the limited liability company for trading activities and Professional activities can be carried out with a Professional license as foreigners can exert significant control over them and it requires a relatively small amount of minimum capital to start up. Previously limited liability companies in Dubai were required to have a minimum share capital and other Emirates as well. However, following an amendment to Article 227 of the Companies Law shareholders now have the right to determine the share capital of their limited liability companies, provided that such company will have sufficient capital to achieve its objects.
